Queer Health Revolution Membership Service Agreement- 

This agreement (“Agreement”) is between Habitqueer, LLC, a Connecticut limited liability company, and the undersigned applicant (“Member”) for membership in Queer Health Revolution. 

The Queer Health Revolution (QHR) is a wellness membership community founded and managed by Habitqueer, LLC and directed by National Board Certified Health and Wellness coach Meghan Crutchley, to provide general information and guidelines around nutrition, sleep, movement, habit formation, mindset, and stress & recovery as related to the most recent research on said topics. The QHR membership site is not personal health coaching, templated diets, personal training or exercise programming, or medical advice of any kind. 

ACKNOWLEDGEMENT OF RISK AND RESPONSIBILITIES 

  1. QHR administrators/coaches agree to maintain professional ethics and standards of behavior and to monitor the community, considering the community is not monitored on a 24hr basis. QHR admin is not responsible for the comments or conduct of group members.  QHR will, acting in its sole discretion, take necessary action to maintain the community consistent with the standards contained in this Agreement and Community Guidelines, and in furtherance thereof, reserves the right to remove comments, content, or members from the community.
  2. In all events, Members should consult with a personal physician before beginning any wellness program. Member represents that Member is in good health and has no impairment, injury, disease or ailment preventing them from engaging in active or passive wellness programing including changes in movement, nutrition, sleep, stress reduction, and mindset, which would cause increased risk or injury or adverse health consequences as a result of such changes. Member understands and acknowledges that Habitqueer, LLC. has no expertise in diagnosing, examining or treating any medical condition. Habitqueer, LLC. reserves the right to make the final determination with respect to Member’s inclusion in QHR for any conditions described herein.
  3. MEMBERS PERSONAL RESPONSIBILITY for USE: QHR is a self- paced program where Members are responsible for creating and implementing their own habit practices, utilizing the content modules in their own time, attending live Q&A’s in the Queer Health Huddle, engaging in the designated avenues for support, and are responsible for their adherence to this Agreement and the Community Guidelines. As such, Member agrees that the QHR admins/ coaches are not and will not be liable for any actions or inaction, or for any direct or indirect result of any information provided in the QHR membership and Community. 
  4. INDEPENDENT CONTRACTORS: From time to time Habitqueer, LLC. will make available to the services of independent contractors and guest speakers. Habitqueer, LLC. does not warrant or guarantee the quality of these services and does not guarantee that these services will remain available to you for any period of time, and hereby disclaims all liability arising out of such services.
  5. NATURE OF MEMBERSHIP: Membership does not confer any interest in the intellectual property or assets of Habitqueer, LLC including but not limited to all videos, documents or any other media content provided in each module, that is the sole ownership of Habitqueer, LLC and distribution or posting on social media of this material is prohibited. Membership confers solely the right to use and enjoy the Queer Health Revolution membership content and participate in the QHR Community, according to the terms of this Agreement and the Community Guidelines (as they may exist from time to time) Queer Health Revolution membership, and Member shall be subject to strict compliance therewith. Non-use by a member of QHR does not constitute release of liability for payment.
  6. Members understand that QHR is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any physical, mental, or emotional disorder or diagnosed medical condition. Members understand that QHR is not to be used as a substitute for professional advice by legal, mental, medical or other qualified professionals and will seek independent professional guidance for such matters. 
  7. Members agree to communicate honestly, be open to feedback and assistance, and create the time and energy to participate fully in the QHR program/services, and participate in the membership community as they see fit.  
  8. ELECTRONIC FUNDS AUTHORIZATION: You, the undersigned, agree that Habitqueer, LLC. will charge you monthly/ yearly dues payments according to your membership details. Habitqueer, LLC. will draft your dues payments via Electronic Funds Transfer ”EFT” or your designated credit card on file on the same day of each month for the term of this Agreement or until you provide two weeks written notice to stop such deductions. 
  9. CANCELLATION POLICY: Monthly members can cancel 2 weeks prior to their next monthly payment. If cancellation happens after their monthly payment goes through, then cancellation will be for the next billing cycle. Annual members may cancel after a 30 day period from initial payment. After 30 days the payment is non-refundable. Habitqueer, LLC. reserves the right to cancel membership at any time for any reason. 
  10. MEMBER WAIVER AND RELEASE: Member fully releases, discharges and waives any Claims Applicant may have, now or in the future, against the Released Parties, even if Claims are based on the carelessness or negligence of a Released Party or anyone else. “Claims” as used in this document means any and all liabilities, claims, demands, legal actions, and rights of action for damages, personal injury or death which are related to or in any way connected with membership in Queer Health Revolution which Member or Member’s heirs, personal representatives, successors or assigns could make. “Released Parties” as used in this document means Queer Health Revolution and the ownership of the platform wherein the course/ community is housed, and their respective owners, managers, partners, employees, directors, officers, representatives and agents.

 

Member agrees not to sue Released Parties for Claims, even if the Claims arise from the carelessness or negligence of a Released Party or anyone else. Member agrees to indemnify (protect against loss) and hold harmless each Released Party, from any loss or liability (including any reasonable attorneys’ fees they may incur) defending any Claim made by Member, by anyone making a Claim on Member’s behalf or as a consequence of Member’s actions or omissions, even if the Claim is alleged to or did result from the carelessness or negligence of a Released Party or anyone else.

Member further acknowledges that no warranties or representations have been made to Member about membership activities which are not stated on this form. Member understands and intends that this document act as the broadest and most inclusive assumption of risk, waiver, release of liability, agreement not to sue and indemnity as is permitted by the laws of the State of Connecticut.

  1. SEVERABILITY. If any provision or any part of any provision of this Agreement is held unenforceable, such provision or portion thereof, shall be severed from this Agreement, and such unenforceability shall not affect the other provisions of this Agreement.
